The sword of “Institutional action” is again hanging over head of the senior minister of Punjab Aleem Khan as the CDA reported to the IHC that the provincial minister encroached on government land so as to link his housing society to Kurri Road. Islamabad High Court had ordered the Authority to submit the report by December however it was filed on Saturday (yesterday) after severe criticism by the court.
The housing developer had declared that the road was built on the allocated land however the CDA report negated this claim and disclosed that no permission was sought or granted for the allocation of land for the road. It also pointed out the role of two senior bureaucrats in the said irregularity; who served as CDA chairman in the recent past.

The housing society claimed that the CDA had already approved the road in its concept plan however the CDA categorically rejected the mentioned point and said that although it was included in concept plan for Kurri, it could not be considered an approved layout of Kurri project. It further added that the CDA road was an indicative road and could not be taken as an approved road.
The authority confessed its mistake in permitting Aleem Khan to build the road in May 2018 as this decision let the developer fulfill the required conditions of NOC. It further added that there was no access road between the Park View Housing Society (Aleem Khan’s project) and the main road and if CDA had not granted access through its land the condition could not have been fulfilled as the NOC later was issued on the basis of this access road. The road land was transferred to the Capital Development Authority in May, 2018.
In November 2019, the IHC asked the CDA to justify the grounds on the basis of which the permission was granted to the housing society for utilizing the acquired land and convince the court that it was not a corruption matter to be referred to the NAB.
CDA records revealed that the housing project was granted the permission to use the said land in June 2018 under the chairmanship of Usman Akhtar Bajwa while the next CDA chairman Afzal Lateef allowed the transmutation of some areas in favor of CDA that linked the project to the CDA land. The planning wing of the authority pursued the matter under the leadership of Asad Mehboob Kayani who has since retired. No one was present in the court to represent CDA in Saturday hearing.
CDA and Local Administration abdicated their powers by accommodating a private entity to take law in its own hands, Justice Athar Minallah observed
Justice Minallah remarked that it was the matter of public importance as CDA and local administration collectively surrendered their powers by accommodating a private entity to take law in its own hands. He ordered the CDA chairman to nominate a person who could justify the move of issuing the NOC to Aleem Khan for Park View Housing even after the dismissal of its petition in December, 2017 that had been filed in the IHC in this regard.
The court adjourned the hearing till August 03.
